Unemployment of taxi drivers: these are the 17 points of the agreement with Mintransporte – Sectors – Economy

After carrying out the day of demonstrations on February 22 by the taxi drivers union, the Ministry of Transportation reached an 18-point agreement with the leaders of this transportation service.

Through the document ‘Commitments of the Ministry of Transport and the F2 national committee’, on behalf of the National Government the following points are expressed:

1. The Government of Change has always kept and will keep the doors and channels of dialogue and agreement open with all the legally constituted individual transport actors, to listen to their concerns, proposals and problems; since the beginning of this Government, there have been spaces to listen and discuss the issues, in an audience with the President (October 5, 2022), 17 regional and seven national tables led by the Ministry of Transportation and nine tables led by the Superintendence of Transportation.

2. Faced with informality, illegality and the provision of unauthorized services, we must indicate that the current regulation (Law 336 of 1996) establishes that the public transport service must be provided through transport companies and in vehicles registered with said service, therefore we urge the municipal and district authorities to control compliance with said provisions, and to fully apply Chapter IX of Law 336 of 1996, especially the application of literal e of article 49; Any modification that is intended to be made with respect to this model must be subject to the legislative process, therefore it will correspond to the Honorable Congress of the Republic to carry out the corresponding democratic debate for its modification or adjustment. The Ministry of Transportation and the Superintendency of Transportation are in a position to issue the respective circulars in this regard within the framework of current regulations. For its part, the Superintendency of Transportation will monitor, with the legal tools provided by current regulations, the compliance of the transit and transportation authorities with their legal duties.

3. In terms of technological platforms, the Ministries of ICTs, Science, Technology and Innovation, Labor and Transport, we are going to work, together with all the transport actors, but being clear that any regulation that is intended to be issued will correspond exclusively to the Congress of the Republic within the framework of the democratic debate.

4. In relation to the rise in gasoline prices The Ministries of Finance and Mines and Energy have indicated that the State must resolve the underfunding of the Stabilization Fund and as indicated by the President of the Republic. We must move towards the energy transition, through the Technological Promotion Fund, the replacement of electric vehicles and the review of the tariff setting parameters. The Ministry of Transportation can commit to creating a working committee with the Ministries of Finance and Mines to discuss the setting of gasoline prices and their review.

5. The President of the Republic fulfilled the commitment to taxi driving with the establishment of the differential rate of the Compulsory Traffic Accident Insurance granted by the National Government on December 15, 2022 was that of taxis.

6. The National Government has proposed in Article 205 of the Bill of the National Development Plan that has put a consideration of the Honorable Congress of the Republic, the creation of a Ffund for the Promotion of Technological Ascent for taxis, which allows it to be a source of incentives and resources for the energy transition of this sector with the consequent reduction in costs and polluting emissions. In the work groups that are created, we will work on the construction of viable alternatives so that small taxi owners are the first beneficiaries of the policies and incentives of replacement policies

7. The Ministry of Transport has been working on a bill to reformulate the precarious sanctioning regime for all modes of transport, which is being discussed, built and analyzed with all sectors so that, once agreed with all the actors, it can be submitted to the Congress of the Republic for consideration, where, among other things, concrete tools and instruments for control are consolidated. of the informal and illegal transport that polishes in various regions of the country. We will continue working at the work tables with all the actors in the sector to generate a concerted project.

8. The Superintendency of Transportation will continue to work on monitoring and investigating the transit and transportation authorities to compel them to comply with their functions and obligations.

9. Social security for taxi drivers It is an issue that worries us and for this reason we are going to continue developing the work table with the Ministry of the branch to advance in this regard and at the same time we are going to process a concept request to the Consultation Room and Civil Service of the Honorable Council of State to resolve the concern about the obligation and responsibility towards it in individual passenger transport.

10. The validity of the Driving license for public transport drivers it is established in the National Traffic Code, which is a law of the Republic, therefore, its modification is the exclusive resource of the Honorable Congress of the Republic.

eleven The setting of tariffs for transport in taxis It corresponds, in accordance with the model of constitutionally established territorial autonomy, to local authorities, within the framework of the parameters set by the Ministry of Transportation, which is in a position to review the content of said parameters, from the perspective of sustainability. and the accessibility of the service, always thinking of the user as the axis of any public service policy. Similarly, the Ministry of Transport is in a position to review the existing regulation on transport capacity in the individual passenger service, in a process of joint construction with the actors of the sector and the transport authorities.

12. The Ministry of Transportation has been analyzing and evaluating with the Financial Superintendence of Colombia and will do so immediately with FASECOLDA, the possibility of unifying the policies required for the different modes of transportation, including individual passenger transportation.

13. The Ministry of Transport shows all its willingness to review the Homologation of vehicles for individual transportaccording to the requests and needs of the industry.

14. The Ministry of Transport shows its willingness to issue the necessary instructions to the transit authorities in relation to the requirement of «peace and safe» from companies to carry out procedures, the period for the replacement of taxi-type vehicles and the non-immobilization of taxis due to the lack of the company’s stamp on the cards control.

15. The Department of Transit and Transportation of the National Police is in the process of
construction of a protocol that defines the procedure of the police and traffic agents against the control of transit and transportation.

16. The Ministry of Transportation plans to modification of the resolution that sets the number of travel sheets occasionally for the individual transport of passengers and is in a position to discuss it with the Sector.

17. During the month of March Regional work tables and a final national table will be held to review all the proposals and public policy formulas with all the actors in the following way:
