The illegality control project enrolled by Mintransporte – Sectors – Economy

Two projects that seek to control illegal transportation in Colombia and that are in the Ministry of Transportation and in the Transportation Superintendency call the attention of local authorities to control this matter in the different territories.

One establishes different normative elements so that the mayors’ offices make decisions, control and penalize the vehicles that “illegally provide the transport service on different routes in their localities, a circumstance that shows that this service is provided generally and that the irregular service was apprehended by the communities”.

The other points out that decisions of fines of up to $34,800,000 can even be made and immobilization of those who worked providing these services. He even details the power to immobilize the vehicles: in a first opportunity for five days, then for 20 and in a third opportunity for 40 days.

In the Supertransport document, it is stated that It has been repetitive in establishing local authorities to develop and implement concrete, efficient and effective actions to control all forms of illegality and informality in the provision of the public transport service.so that they can comply with the transcendental obligation to avoid its occurrence and effectively counteract this phenomenon.

In addition, “companies interested in providing public transport service or established for that purpose, must request and obtain authorization to operate.”

It even points out that the State has powers to regulate the transport service, “these requirements mentioned above and in relation to the prior authorizations required and the conditions imposed by law on the vehicles with which the operational service, are provisions relating to public services will benot the private ones.

And in the same way: “The private transport service is one that tends to satisfy the mobilization needs of people or things, within the scope of the exclusive activities of natural and/or legal persons…”, he points out.

A project against applications?

In the draft that is open for comments until today, March 2, the fact of driving a vehicle to provide a public service without the proper license is penalized, which would include mobility applications for being suppliers and applicants of the transport service .

Fines of up to 30 daily legal minimum wages are even stipulated, that is, about $34,800,000.

It is enough to see the result of the observations to these documents, the application and the future of the same. Well, for example, in the case of the regulation of applications, the Minister of Transportation, Guillermo Reyes, would have argued that until there is a consensus, no decisions will be made in this regard.
