The objective of these procedures is to verify that if they are issuing the Electronic bill and that they are doing it well, only asking consumers for the three mandatory data, which are the name, ID and email.
“We have found that in some cases they ask for an address, telephone number and personal data, which can even mean insecurity for the consumer,” said Cecilia Rico, Dian’s director of revenue management.

Dian officials inspect the premises of shopping centers so that they issue the electronic invoice.

List of bad practices when invoicing:
Due to this problem Colombian Securitycompany that offers electronic invoicing solutions, prepared a list with the bad practices they have identified:
1. The buyer is being asked if he wants or invoices, when the legal obligation is to issue and deliver it in all cases. This must be issued at the time of the transaction.
2. In the case of large taxpayers, it was found that despite being obliged since February 1 to issue the Electronic bill instead of the POS system ticket, when the sale of the good or service exceeds 5 UVT, that is, 212,060 pesos (year 2023) without including taxes, they are not delivering the invoice and they send them to a notice where they indicate an email to request it.

3. Non-existent requirements are being requested from buyers in article 617 of the Tax Statute and in resolution 00042 of 2020, such as attaching RUT, copy of identity card, chamber of commerce certificates, among others, or indicating different identification information, name or Company name and email to obtain the invoice.

Despite the fact that all companies are obliged to issue it, Dian is behind them because they have identified that some are creating obstacles.
4. They tell the buyer that they must enter the web pages and fill out and attach information that does not really correspond to what the regulations are requiring.
5. In some cases the buyer does not receive the Electronic bill and what is delivered is a document that is not equivalent, that is, the purchase is not invoiced.
6. Another bad practice is that the invoice or the equivalent document is not delivered and the buyer is asked to enter “wholesale sales”, without further indications.

7. Buyers receive their invoices hours or days after the purchase and on other occasions they do not receive them.
8. The requirements of the graphic representation of the invoice do not meet the requirements. For example, the QR is illegible in most cases or the information of the software manufacturer is not related (surname and first name or company name and Tax Identification Number -NIT, of the software manufacturer, the name of the software and the provider technological).
